Terms of Service

Effective April 20, 2026

Welcome to Spotted Bingo. These Terms of Service (“Terms”) govern your use of our iOS application and related services (collectively, the “Service”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.

2. Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@kenparsolutions.com if you suspect unauthorized access.

3. User Content

You retain ownership of the boards, squares, proof photos, and other content you create (“User Content”). By submitting User Content, you grant Spotted Bingo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and improve the Service. If you publish a board to the Explore directory, you additionally grant other users the right to copy and play your board within the Service.

5. Subscriptions and Purchases

Spotted Bingo offers optional Pro subscriptions (monthly, annual) and a lifetime purchase through Apple’s In-App Purchase system. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in iOS Settings › your Apple ID › Subscriptions.

All purchases are processed by Apple. Refunds are handled per Apple’s refund policy. We do not issue refunds directly.

6. AI-Generated Content

The Service may generate square suggestions using a third-party AI model. AI output can be inaccurate, offensive, or unexpected. You are responsible for reviewing AI suggestions before using them. Do not submit prompts containing personal information, secrets, or content that violates Section 4.

7. Ads

Free users see ads served via Google AdMob. Pro subscribers see no ads. We are not responsible for the content of third-party ads.

8. Third-Party Services

The Service relies on third-party providers (see our Privacy Policy for the list). Your use of those providers’ services is subject to their own terms.

9. Intellectual Property

The Service, including its design, source code, trademarks, and branding, is owned by Spotted Bingo and protected by intellectual property laws. Nothing in these Terms grants you a license to our trademarks or branding.

10. Termination

You may stop using the Service at any time and delete your account from the Profile tab. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTTED BINGO AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU HAVE NOT MADE ANY PAYMENTS.

13. Indemnification

You agree to defend and indemnify Spotted Bingo from any claims, damages, or expenses (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law; Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

15. Apple-Specific Terms

You acknowledge that these Terms are between you and Spotted Bingo, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide support for the Service. In the event the Service fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. We will revise the effective date above and, for material changes, notify you in the app. Continued use after changes means you accept the updated Terms.

If you form a legal entity, swap “Spotted Bingo” for the entity name.
